Affiliate Terms and Conditions

Thank you for joining the LakCloud (Pvt) Ltd Affiliate Program ("Program"). By signing up and participating in the Program you agree to abide by the following terms and conditions ("Terms"). Please read these Terms carefully.

1. Eligibility

To be eligible to participate in the Program, you must:

Be at least 18 years of age.

Own and operate a website, blog, or social media platform that aligns with the values and services of LakCloud (Pvt) Ltd.

Be an active user and have purchased at least one product or service from the LakCloud website.

Not promote LakCloud (Pvt) Ltd on platforms containing offensive, defamatory, or illegal content.

2. Affiliate Registration

Participation in the Program requires submitting an application, which is subject to approval by LakCloud (Pvt) Ltd. We reserve the right to reject any application at our discretion, particularly if the applicant's promotional methods or platform are deemed unsuitable.

3. Affiliate Responsibilities

As an affiliate, you agree to:

Accurately and positively represent LakCloud (Pvt) Ltd services.

Utilize only the authorized affiliate tracking links, banners, and marketing materials provided by LakCloud.

Avoid making misleading or exaggerated claims regarding LakCloud’s services, pricing, or promotions.

Adhere to all applicable Sri Lankan laws and regulations governing affiliate marketing and online advertising.

Disclose your affiliate relationship with LakCloud where required by law.

4. Affiliate Commissions

Affiliates are eligible to earn commissions under the following conditions:

The referred customer completes their sign-up using the affiliate's unique tracking link.

The referred customer completes full payment for LakCloud’s services.

The referral is not canceled, refunded, or subject to a chargeback within 30 days of purchase.

4.1. Commission Structure:

The commission percentage varies based on the product and the promotional offers active at the time of the sale.

Commissions are paid out on a monthly basis, within 30 days following the end of the month in which the commission was earned.

Payments are issued via bank account, and funds will be transferred within 5 working days of the payment request. However, payment times may vary depending on the USD exchange rate.

A minimum payout threshold of USD 100.00 must be met before payment is issued.

4.2. Payment Withdrawal Procedure:

To withdraw earned commissions, the affiliate must follow the procedure below:

Log in to the LakCloud client account.

Open a ticket and select the Affiliate Team from the available departments.

Mention that they wish to withdraw their earned commissions to their registered bank account.

LakCloud will carry out a verification process to ensure all withdrawal details are correct.

If the verification is successful, the payment will be processed, and the funds will be received within 5 working days. Please note that payment times may vary due to USD rate fluctuations.

5. Prohibited Activities

Affiliates agree not to engage in the following prohibited practices:

Self-referrals or any form of fraudulent activity to manipulate commission earnings.

Spamming or sending unsolicited bulk emails to promote LakCloud (Pvt) Ltd.

Offering unauthorized discounts or incentives to induce referrals to sign up via your affiliate link.

Misusing LakCloud’s trademarks, logos, or branding in any deceptive or misleading manner.

Falsely representing your relationship with LakCloud (Pvt) Ltd as anything other than that of an affiliate.

6. Affiliate Termination

LakCloud (Pvt) Ltd reserves the right to terminate an affiliate's participation in the Program under the following circumstances:

Violation of these Terms.

Evidence of fraudulent activity or legal violations.

Discontinuation of the Program by LakCloud (Pvt) Ltd.

In the event of termination, the affiliate will forfeit any unpaid commissions.

7. Modification of Terms

LakCloud (Pvt) Ltd reserves the right to modify or update these Terms at any time. Affiliates will be notified of significant changes via email or an announcement on the LakCloud website. Continued participation in the Program following any changes constitutes your acceptance of the updated Terms.

8. Limitation of Liability

LakCloud (Pvt) Ltd is not responsible for any damages, losses, or expenses incurred as a result of your participation in the Program, including indirect, incidental, or consequential damages.

9. Data Privacy and Compliance

Affiliates are responsible for ensuring that their promotional activities comply with all applicable data privacy laws, including, but not limited to:

The General Data Protection Regulation (GDPR), which governs the collection, use, and sharing of personal data of individuals located in the European Union (EU).

The Sri Lankan Personal Data Protection Act No. 9 of 2022, which sets standards for the collection, processing, and protection of personal data within Sri Lanka.

Affiliates must:

Obtain necessary consent from users before collecting or processing their personal data.

Clearly disclose to users the nature of the personal data being collected and how it will be used.

Ensure that personal data is stored securely and is not shared with unauthorized third parties.

Implement procedures to respond to requests from individuals exercising their rights under applicable data privacy laws, including requests for access, correction, or deletion of personal data.

Failure to comply with these data privacy regulations may result in immediate termination from the Program and could subject the affiliate to legal penalties.

10. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, specifically under the Sri Lankan Personal Data Protection Act No. 9 of 2022. Any disputes arising in connection with these Terms will be exclusively resolved in the courts of Sri Lanka.
